香港收回土地建屋之爭辯調解

Mediation for the argument of reclaiming land for housing development in H.K.

High price for housing in H.K. is well known in the world. The price is keeping up due to short supplying of housing. Government claims that it is hard to have solution for this problem, due shortage of land supply. But the opposition claims that it is the government not to use the land effectively. Lots of land in New Territory is changed the usage but without proper compensation for such changing. Also, there involves transfer of benefits between government and the consortium. Such as golf club, the organizer pays a small amount of money to government and have a large piece of land for the club but there is only a few of people could enjoy the use of the club. This is unfair for the public. This kind of land should be used for building housing to solve the lack of housing problem.

Government suggests to develop the country park and to develop the old village to get land for building housing. Opposition does not agree with these proposals as developing the old village means to expel to resident from the village out and it is oppressing the disadvantaged social groups. They are afraid that once this precedent is established, the government will keep using the land without hesitation.

The aim for both sides is clear and the same. It is to find land for building housing. But they are keeping the own stand without concession and it is hard for them to make concession on meeting face to face. Mediation could be helpful to dig out the bottom line that both sides could be accepted as mediation would have separate meeting with each other is necessary. It would be easy to let each party to talk with mediator frankly in order to find out the bottom line and finally helping both sides to reach agreement.   

香港樓價貴是世界聞名的。在供應少,需求多的情況下,樓價在不斷上升。政府解釋是沒有足夠土地建屋。但有反對意見指出有不少閒置之土地沒有好好利用。為了尋找土地, 各方面都出盡方法嘗試利用不同土地去建屋。在這方面市民與政府各持己見。相持不下。

在增加土地建屋之方案下,政府要收回村落,開發郊野公園,土填海造地。

但反對意見則認為認為可收回高爾夫球場。因此種設施只供少數富有人士享用,他們用低價租用土地,建成會所供少數會員專用。這樣是浪費土地及對社會資源之不公分配。另應收回已改變用途之新界土地。這些土地由於農土沒有人租用或已荒廢,土主將之改變為貨埸或維修埸,在這改變下,土主並沒有補償土地改變用途之土地價。這樣是濫用土地謀取暴利。政府不應縱容此種現象。雙方爭持不下。激烈爭辯。各不相讓。

覓地建屋是香港急需解決問題。在雙方提出之解決方案均是可行之方法。但每個方案均有其利弊之處。

收回村落發展土地作建屋之用,此建議會引起爭議。收地談判及賠償時間會很長並會引起收地不公之爭。會引發很大的社會問題。

開發郊野公園,利用土地建屋。市民怕開了壞先河。一旦允許開發郊野公園,此後便有先例可援,政府以後可隨意以欠缺土地為藉口,不斷取用郊野公園。郊野公園從此在香港消失。香港石屎森林化更趨嚴重。

土填海造地是最容易執行之增加土地方法之一,此方法並不需要作收土談判。沒有利益衝突。沒有欺壓弱勢之口實。但填海造地需要投入之成本非常龐大及需要較長時間完成並且對海洋生態及環保構成問題。

收回高爾夫球場的方案可行,但反對者批評這樣會防礙高爾夫球之發展。香港作為國際都會但缺乏高爾夫球場,實在太笑話。另外,高爾夫球場內有部分建築物是歷史建築,需要保育。發展高爾夫球場會受一定限制。

收回已改變用途之新界土地是一個不錯之選項。但這方案需談判賠償問題。地主會要求巨額賠償。此類談判是艱巨及漫長的。

其實此爭辯是不難解決的。雙方目的均為多建屋。而問題是目前沒有足夠土地並需要尋找土地。這是雙方共同目標。只不過目前雙方各自對收地之方法有不同取向並針鋒相對。

其實目標一致,其他方面可以求同存異,找出共同點,便可達致雙嬴局面。現在對立雙方都因為自己的立場而不肯妥協。以致雙方爭持不下。

通過調解可為雙方找到解決方案。雙方既已有共同目標,只要平心靜氣,放下成見,好好討論,必能達成協議。雙方面對面時會為了面子而不肯讓步。在與調解員私下會面時會比較容易提出妥協之底線。

調解正是找出雙方之共同利益而達至解決方案之妥善機制。經過成功之調解,可以找出雙方之底線。避免衝突。從而達至解決方案。
